ACKNOWLEDGMENT AND ASSUMPTION OF RISK

I, hereby acknowledge that I have voluntarily chosen to participate in Reformer Pilates classes and related classes offered by The 1920 Room Inc.(the "Studio") I fully understand that participation in these activities involves inherent risks, including but not limited to, physical exertion, muscle strains, falls, equipment related injuries, and other potential hazards that could result in person injury, illness, disability, or death. I voluntarily assume full responsibility for any risks, injuries, or damages, known or unknown, which I may incur as a result of my participation in any class or activity at the Studio.

PHYSICAL FITNESS AND HEALTH

I affirm that I am physically fit and have no medical condition that would prevent my safe participation in Reformer Pilates classes. I acknowledge that it is solely my responsibility to consult with a qualified healthcare professional before engaging in any exercise program, including those offered at the Studio. I further acknowledge that I am responsible for informing the instructor of any medical conditions, injuries, or limitations that may affect my ability to participate. If I a pregnant, I affirm that I have received medical clearance from my physician to engage in Pilates classes, including both prenatal and postnatal sessions. I understand that the Studio and its instructors are not liable for any complications or injuries that may arise in connection with my participation. I understand I must disclose my pregnancy should I participate in regular scheduled classes not deemed prenatal or postnatal. I fully understand the Studio and its instructors fully recommend only participating in prenatal classes during the term of my pregnancy.

WAIVER, RELEASE, AND INDEMNIFICATION

In consideration of being permitted to participate in Pilates classes and activities at the Studio. I hereby waive, release, and discharge The 1920 Room Inc., its owners, directors, officers, employees, instructors, agents, representatives, successors, and assigns (collectively, the "Related Parties") from any and all claims, demands, causes of action, liabilities, costs, or expenses, whether known or unknown, arising out of or in connection with my participation in any class or activity at the Studio. I expressly agree to indemnify, defend, and hold harmless of the Released Parties from and against any and all claims, liabilities, damages, costs or expenses (including attorneys' fees) arising out of or relation to my participation in classes, the use of the Studio equipment, or any injuries sustained on or around the premises.

ACKNOWLEDGEMENT OF UNDERSTANDING

I have carefully read an fully understand this Participation Agreement, Waiver, and Release of Liability. I acknowledge that I am voluntarily signing this agreement and that by doing so, I am waiving substantial legal rights, including the right to sue. I agree that this waiver is intended to be as broad and inclusive as permitted by applicable law and that if any portion is found invalid, the remainder shall continue in full force and effect. NO REFUNDS OR EXTENSIONS- no refunds: I acknowledge and agree that all sales are final, and the Studio strictly enforces a no refund policy on class packages, introductory packages, memberships, late cancellation fees, and no-show fees. -no extensions: I understand that class packages, including introductory packages, are non-extendable. the expiration date is strictly enforced, and it is my sole responsibility to schedule and complete my classes before the package expires. the activation date begins on the date of purchase, regardless of when I attend my first class. it is agreeable should I purchase a class package or membership I can pick a start date as agreed to with both parties, however the expiration from the start date is strictly enforced.

WAITLIST & CANCELLATION POLICY

Waitlist policy:-if you added yourself to a waitlist, you may be promoted into class up to 2 hours before the scheduled start time. you will be notified by email and/or text when/if you have been promoted into class.-if you are no longer able to attend, it is your responsibility to remove yourself from the waitlist in advance.-if you are promoted from the waitlist and cannot attend, you will be subject to the late cancellation fee or no-show fee. - if you remain on the waitlist and are not promoted into class, the session will be returned to your package for future use. -it is fully the client's responsibility to manage their schedule and check for waitlist updates.

Cancellation policy:-to ensure fair access to classes and effective scheduling, we enforce a 12-hour cancellation policy:-late cancellations (within 12 hours of class start time): $15 fee and loss of class credit- no-shows (failure to attend without cancelling): $25 fee. if you are unable to attend a class, you must cancel at least 12 hours in advance to avoid these fees. this policy helps us accommodate all clients efficiently while maintaining the high level of service you expect.

I grant The 1920 Room Inc. the irrevocable right and permission to photograph and/or record me during classes for promotional, marketing, and social media purposes. I understand that I will not receive any compensation for the use of my image, and I waive any rights to royalties or claims for future compensation. If I do not wish to be photographed or recorded, I agree to notify the Studio in writing before participating in any class.
